Who Can Make a Refugee Claim in Canada?

You may be able to seek protection in Canada if you have a well-founded fear of persecution based on:

  • Race
  • Religion
  • Nationality
  • Political opinion
  • Membership in a particular social group
    (such as gender-based risk, family, sexual orientation, etc.)

Or if you face:

  • Risk to your life
  • Risk of cruel or unusual treatment
  • Risk of torture

Each case is reviewed individually by the Immigration and Refugee Board of Canada (IRB).

Where Refugee Claims Are Made

Refugee claims may be made:

  • At a Canadian port of entry
  • Inside Canada
  • In some cases, after an arrest or immigration interview

Eligibility depends on several legal factors. We review your history to determine whether your claim may be referred to the IRB.

What Happens After a Refugee Claim Is Filed?

If your claim is eligible:

  • It is referred to the Refugee Protection Division (RPD)
  • You will receive a refugee claim hearing date
  • You must submit evidence, documents, and your personal narrative
  • A Member (decision-maker) will decide your case after the hearing

If accepted — you may apply for Permanent Residency.
If refused — other options may exist depending on your case.

  • Medical, police, or legal reports (if applicable)
  • Witness statements (if available)
